The tenant requested us to fix the leaking roof in the condo unit that we rent out to him. We cannot fix it ourselves because the HOA is responsible to do so. Since other condo units owners experience the same leaking problems, the HOA decides to replace the entire roof in summer. The HOA said patching it now will not keep the water accumulated from the rain to leak into the condo units because the roof is a flat top roof. So the only solution is to replace the roof. We have 2 problems now:

- the tenant begins to reduce rent money and won't pay until the roof leak is fixed because the water leaks into his bedroom. Since he doesn't use the money to do the repair himself, is it illegal for him to keep part of the rent money every month until the roof is replaced? Can we treat it as rent witholding until the roof leak is fixed?

- since we cannot fix the roof ourselves (the HOA will replace the roof in summer), we want to paint the ceiling to cover up the water stain as repair to the roof leak problem for now. If it doesn't rain heavily, the roof will not leak. Can we demand the tenant to pay us back the rent after we paint the ceiling? Can we evict him if he doesn't give us back the rent?

Please let us know what we can do in this situation to prevent the tenant from using the repair excuse to reduce the rent payment.

Get from your HOA a written letter explaining the repair schedule and then go see a real estate atty and ask for a opinion on your odds of wining a eviction and If the Atty gives you a good green light then reject the next short rent payment and start your states proccess for evictions based on non payment

You may have already shot yourself in the foot... Verify with your states LL/T laws in regards to accepting partial paymenrs...

Did you already accept and deposit a partial rental payment?


Some states, Georgia is one, state that a LL cannot refuse a partial rent payment if they have already accepted partial payment in the past without first giving proper notice to the tenant that a partial rent payment will not be accepted.

It is in there... there are different ways to go on this situation people...
is it a big hole in the roof making it unliveable... is there damage being done... is it because the tenant can't stand looking up at the water stain because it looks like his mother- in- law... WHAT?

There are scenarios upon scenarios... (don't make me pull up a quote... because I will.)

Actually I already went thru the dca web site and I can accept partial payment and still evict. THe problem is the timing of the roof repair which I have no control because the HOA needs to collect $ to replace the roof. If someone has gone thru similar situation, pls tell me if I can evict in this case if the tenant will not pay back rent after I do the only repair I can do at this time to the roof leak... :cool:

I have not been in a similiar situation... but really.. would like to know..

How big is the leak? Is it making the dwelling unlivable...

Is the tenant having to vacate his bedroom and is inconvenienced because of this? Any damages?
Has he notified you in writing about anything claims of such. How much has tenant withheld...?

Or is the tenant just being difficult.

California is getting quite a bit of rain these days... more than Seattle.

The HOA... can only fix it by summer... bah humbug... in the summer I would want a hole in my roof...
Somethings are not being reasoned out here... and to think about eviction without looking at all angles sets you up for some problems in the future IMO.

Do you honestly think that if you evict this person that a new tenant will put up with it. If I was your tenant and you even tried to evict me over this you would be staring at the inside of a courtroom.
