Rental Late Fees

Can a landlord charge for late payment of rent fees going back 6+ years?

My mother recently moved out of a townhouse she had been renting for 10+ years. After moving out she received a notice from her landlord charging her with $1,170.00 worth of late rent fees. The letter stated that the fees were from 1-98 to current. She never received any type of notice regarding these fees and nothing was ever said by him.

In addition, my stepfather was the one who took care of most of the bill paying and he passed away in June so there is no way to prove whether or not the rent was paid on time.

Is there anything she can do?

It states that the rent is due on the 1st day of the month. If the rent is not received or postmarked by the 2nd day of the month there is a $10.00 per day charge for the late rent.

**A: ok, so there is already notice and acceptance of late fee charge. Thus there is no requirement for a second demand or notice. Poor practices on account of both tenant and landlord. You are going to have to negotiate now.
