What is the name of your state? Maryland. We own a sm. business. (Tree removal service) A key pc. of equipment (our chipper) was damaged in an accident 06/13. To date, equipment not properly repaired! Sent letters to both mfg. and repairing co. Response from repairing co was: not our fault, mfg. delayed parts shipments! Mfg. has finally responded with a replacement, due this week. Is taking our equipment back to factory due to improper repairs and equipment being started and run with no grease or fluids in it! We documented loss of revenue, expense for renting replacement, increased manpower, hauling and tipping fees, etc., total almost $25K! over 7 weeks. This spreadsheet was included in our letters to both companies. The repair co. "principal" called to tell us he didn't owe us anything but the repaired equipment! He also demanded payment for the full repair (which we came to discover wasn't complete nor did they act responsibly by starting it with no fluids)
Our insurance covered original estimate of $5,400. I am trying to be brief without being vague. The piece of equipment is worth $22K and may now be totalled, due to their negligent repair practices.
Do we have a legitimate case here?
