Responsible for mold?

My family and I moved into a townhouse this past September. Nothing seemed out of the ordinary. Once winter hit, however, we were bombarded with mold in our kitchen closet and bedroom closet (right above kitchen closet). I sent a letter to our landlord with our Febuary rent check and we didn't hear back from him for a few weeks. WHen he called he told my husband that he would let us out of our lease if we wanted because we are going to have twins this summer and it would put us over the amount of people he'll allow per bedroom. Nothing was said about the mold. I called him on Feb 17th to ask him about the problem and he just said that we are not to use the closet, to keep the door open and turn on our ceiling fan to get the air moving around in there. He said nothing can be done about it.

I am concerned about the mold though. I am a stay at home mom with a 21 month old child and I am pregnant for twins. We are in the house all day every day and it seems like we always have colds. My 10 year old is asthmatic too. I really don't want to bring my twins into this place unless I know for sure if it is a bad mold.

I've heard that if I want to have the mold tested that it is my responsibility, not my landlords. This does not seem right since it is a health hazard.

Could you please shed some insight?

You could call the Health Dept . and have them come and investigate the issue .

If they find mold , they will take what ever action is necessary .

It doesn't matter how many people the LL allows in a unit ( can't discriminate against children ).
It matters what the Housing Laws are about occupancy .

I completed a mold inspection & remediation class. I have also spent many hours, many days, researching the the effects of mold on the human body.
None of which qualifies me to say much, but I can tell you this.. You and your family need to vacate the house.

Your post states there are some medical issues going on with you and your family. Try this; Make a list of symptoms for each member of your family. Leave the house for at least one week. At the end of one week scratch off from the list, all the symptoms that have mysteriously gone away!

I almost died from mold. I'd thought to myself many times during the course of about 8 mos. That I was dying. All the symptoms I had became worse with time. In November my wife insisted we go away for a week.

At the end of that week I'd felt better than I had in a long time. Until we returned home. Within an hour of being back in the house, I could feel myself becomming sick again. Thats when I figured out that the house was killing me, or rather the toxins produced by mold were.

As for your landlord. The man is attempting to sweep the mold issue under the rug. Such a generous offer to allow you out of the lease. This guy is a real prize.

Make a phone call to your county/city Building Inspectors Office. Talk to an inspector working in the Code Enforcement Division. Tell this person about your mold issue and about the sweet deal your landlord offered you when presented with the problem.

Next thing to do is hire an attorney who handles mold issues and sue your landlord!!

But first! Get out of the house before things become worse. You have nothing to loose.

A note on MD's. most of them are clueless when it comes to diagnosing and treating symptoms caused by mold. When seeking medical advice regarding symptoms where mold is the suspected cause, you will need to find a Mycologist. Doctors hate me.
