Restraining order against bully Property manager

I am going to my local police department but can anyone advice about getting a restraining order.

The residents at our apartment complex have many complaints about the leasing office manager. Even when we complain to corporate office there is no help.

The leasing office and handyman conspire together to send notes to residents, they want to micro-manage us. About our housekeeping, where we park cars, threatening to tow our car because of leaks yet we barely have any and other cars in the complex are leaking worse.

WE have complained and reported her to the COrporate office but have had no help.

We are the 3rd residents with this problems. The others gave up and moved.

I have complained to the BBB, but now I need to prevent this woman suddenly showing up at our door with her constant threats and HARRASSMENT.

WE get shut up by eviction notices.

i am just FRUSTRATED. I need help before I move. Each month it gets worse.

There have been police incidents at the complex which have not been addressed but we have to put up with all this crap!!!!

ANY SUGGESTIONS, will her nasty letters and my responses be enough to get the order of protection against this crazy lady???:mad:

NO. An order of protection is for when you are at risk of being physically harmed/killed...obviously NOT the case here LOL.

To me it sounds as though all you are dealing with is written warnings of items where you are at risk of breaching the contract somehow. Sounds like a very "hands-on" effective management.

If your car leaks any fluids, you can and should be warned about it since auto fluid leaks can cause very hard to remove if not impossible damage to surfaces.

It is likely that your written lease and/or house rules cover the items you are "complaining" about being warned about. You should remain always professional and keep all communications with management in writing only.

Auto fluid leaks. Where you park. Even the care and maintenance of your place can all be included in the house rules and/or lease. Extremely poor housekeeping can lead to all sorts of more serious problems that can even affect other tenants..perhaps that is their concern. Rodents, insects, odors, damaged surfaces, inability to detect repair needs, inability to access areas needing repair, etc.

Anyway..to answer your question..NO a restraining order if NOT warranted here.

You say you are shut up by eviction notices..so there is obviously more to this story. You apparently are close to if not already breaching terms of your agreement/rules in the eyes of management.

If you wish to move to a more "loosely" run place where management does NOT keep such a close eye on things, if you have a MTM agreement, simply feel free to give the legal notice required in your state and agreement and move. Keep in mind that if you are MTM, the owner/management can terminate YOUR tenancy the same way..without even stating a reason (most states/cities that is).

Or when your fixed term lease comes due...same thing.

The corporate office is probably pleased with her 'policing' efforts and in fact may have hired her specifically to do just that. Perhaps they are trying to get a high quality of tenants there and get and keep the building in great shape. Yes some management tend to go overboard with power trips but if the job is getting done..rarely does their superiors worry about it.

Without you posting more specific information like what kinds of evictions notices you have been served, etc...no one can really provide any other input to you or speak to "harrassment" claims. And of course your paraphrasing any communications is not the same as reviewing them.

I would suggest you very closely read ALL documents pertaining to your tenancy..the primary contract, addendums if any, house rules, notices, etc. Then ask yourself honestly if some if not all of the items you have been noted for are in there one way or the other.

You do have a choice..you can MOVE OUT..with appropriate notice. It seems corporate is not going to do anything to change this and in fact is probably happy with her so since you are not...depending on the type of agreement you have...I'd look for another place.

EVEN IF you have a fixed lease..sounds like they are not happy with you either so they may be willing to let you break it...never hurts to ask.

If you feel you are being harrassed, you already said you are going to the police so you can see if they will do anything..not likely...but I guess it's worth a shot..though it might just get you "out" even sooner. Why do you need help BEFORE you move? And what type of "help" do you expect to get?

Save your $$$ and move. Obviously the corp office believes in their PM and is backing them v residents.

Most areas of the country are reporting very tight/tough rental markets for residents so unless you want to see a "double wide" in your future, chill and abide by the property rules. PM is only in your face because of your attitude and disregard for the rules of the property.
