Restraining Order

What is the name of your state (only U.S. law)? Can I get a restraining order or order of protection against my upstairs neighbor who is harassing me? He hasn't hit me yet, and we have no type of relationship other than he lives upstairs. I just want to show him that I'm not going to deal with it anymore. I just want to be left alone. Would a judge grant one based on verbal harassment? Thanks for any help.

If there is no documented violence or threats of violence, I'd say you are jumping the gun. If you feel so harassed and if you are in fear, why haven't you involved your local p.d.?
 
What kind of "verbal harassment"?


I have involved the police. Myself and my friend asked him to turn down his music on two different days but he never did. I called the landlord and they told me to call the police. I called the police on him and that's when the harassment began. At this point twice he has walked past my door and shouted nasty things at me. He's also yelled at me from his balcony as I was driving out of the complex. He also walked out on the balcony when he saw me coming and said nasty things. I then walked around to my car and he just so happened to be bringing out a bag of garbage at the same time. He said more nasty things to me. I've called the police several times about his music. This last time he had loud music plus he was jumping up and down just to disturb me. I reported this all to the police and they wrote him a ticket for the noise.

I just want him to leave me alone. I've never initiated contact with him except the first couple days I was here and asked him politely to turn it down. I don't want to have all this drama and I don't want to be at war. I mostly don't respond to his comments because it just gets me more upset. I just want him to leave me alone. Whenever I try to do something about it he just escalates.

Some quotes of what he's said "Welcome to the building bitch." "You're a loser. I have a wife and kid, what do you have?" "Psycho" "I knew that cop." "What the hell? This is an apartment, get used to it." "How many friends have you made in the building?" "You need to be relocated. That's what I want."
