What is the name of your state? California. I bought a used 1998 Volvo from a private party. He gave me a list prepared by the Volvo dealership of repairs the car needed that he did not have done. The seller told me that the only work the car needed was on that list. He said that he had a good title for the car but would not release it until my check cleared. I took the list and the car to my mechanic the next day to have that work done only to have him discover obvious damage to the frame and subframe. I then took the car to a body shop where I was told that the car had probably received some impact that resulted in the damage to the frame as well as to the molding visible under the hood. The seller did not disclose that information to me. The seller claimed the he did not know the car had a damaged frame. I told the seller I want to return the car and get my money back. He said that he does not have the money I paid him for the car. The carfax report on the car shows that the car has a salvage title and that the car was in a accident that voided the warranty. What recourse or rights do I have? Do not said caveat emptor, please!

Bottom line... sounds to me like you should have had the car inspected BEFORE you purchased it.
Simply, if he refuses to rescind the contract (and that IS what this 'deal' is), your only real recourse is to file a lawsuit..... and hope that the court sees it your way (unlikely in my opinion).

Was he the only owner of this vehicle? If so, then he would obviously know about the damage. If the damage occured when he did not own it, then it's possible that he did not know. Again, the two things you should always do prior to puchasing a vehicle is to have a mechanic look at it and run a carFax report. This will help in about 95% of the issues.
