Did you happen to mention to this attorney that you have already put that same information you are so concerned about privacy for, out on a public internet board where anyone, INCLUDING THE PEOPLE YOU DO NOT WISH TO HAVE IT, can see it anytime they want to?

His medical information is one thing, and that was blasted out of the water because mom is not bound by HIPPA, but his criminal information is a matter of public record.

This tool should go to his attorney and pay up. At least he will be contributing to the economy:D

Of course public information is not private. And prior to this thread, he told this forum about a good part of the information he's now claiming should be private.

But for the moment, let's assume that his alleged attorney (I call OG factor here) is right and his right to privacy was violated when his wife gave up the information. So, who does he get to sue? The person who did the violation, of course.

The only person he can sue in that case, is his own wife.

You guys don't get it... a consultation for ADD has no relationship to a fathers prescription drug history or personal medical records.

There is a correlation between parental drug use (yes, even dad's) and a diagnosis of ADD/ADHD, developmental and/or behavioral issues with their children. Your history IS relevant.

Actually, you should read the studies... then know that lealea is a medical professional...

My doctors have my family medical history. All relayed by me. I suppose my mother, father, sisters, grandmothers and grandfathers should sue me because I told their business.

Felony Drug possession and NCIC Database

What is the name of your state (only U.S. law)?

I was arrested for felony [class d] drug possesion of crack cocaine and oxycodone and go to pre-trial conference with prosecuter in 2 wks. I am in my 50's and have had no arrests for over 25 yrs but had a dui with a joint in my car in the early 80's and a couple of pot possesions in the 1970's. Nothing shows up on the background check for the local search but I'm concerned about the NCIC.

My atty says he has no access to NCIC and thinks we should wait and see if they bring it up first. That seems like a passive approach. He also says the worst I'm looking at is 12-18 mos probation??

Do I have something to worry about here?What is the name of your state (only U.S. law)?

Of course I want my son to have the help he needs... but that is a completely separate issue.

I believe I have a right to keep my own personal medical background to myself and I should be the one to choose who I disclose it too.

This is a conservative christian school and they have rigid values and essentially believe it is wrong and sinful to have a drug dependency... also drug dependence implys addiction and perhaps illegal and/or criminal behavior. My dependence is related to pain mgt treatment of shell fragment wounds from the war. Prescription drugs. At the very least... this should have been clarified.

I feel my reputation has been damaged... not to mention how that may reflect on the teachers and school counselors attitudes/view of my son.

I'm sorry...When exactly did crack become a Rx drug??? :rolleyes:

Not opinion, it's a fact. There have been numerous studies that find the toxins from the drugs & alcohol affects the quality of the sperm which leads to fetal alcohol syndrome as well as the possibility of behavioral & learning disorders, as well as ADD/ADHD. Maybe you're just not willing to accept that fact. You are the parent. Man up. Your embarrassment is (or should be) inconsequential to getting your son the help/support he needs.

And I will also point out again, that even if you were right (which you are not, under the law) the only person you could sue would be your wife.
