my babies dad and i are not married and never have been. he is an ilegal imagrant. i need to know what rights he has to my baby. i'm afraid he will take her to his country

My response:

Without court orders for Paternity, Visitation, and Child Support, yes, he could theoretically, and legally, take the child wherever he wants. While even with court orders he could leave the country with the child, it would be very difficult.

If you feel that he is a "flight risk" and would take your child no matter what orders may, or may not, be in place, then I would suggest that you have orders made that require "supervised visitation".

Thank you for responding. My babies dad really has nothing to do with her. he tells me he's coming to see her and never shows up, he hasn't seen her in almost two months. i know he loves her but his life definatly comes first. i don't let him take her on his own and he has never asked. i have always felt i would never stop him from seeing her but latley when i talk to him he can be very mean and has talked about taking her to live with his family in his country. I don't know what to do because he is ilegal, i don't feel i can bring him to court can i? my biggest fear is that he will take her from me. what should i do? Also i would like to have a will drawn up to keep her with my parents if anything should happen to me. how do i go about that? do i need a special type of lawyer?

I don't care, and it doesn't matter, if your baby's Dad is from the planet Mars. The courts are always available to you, and your baby.

You need to see an attorney so that a Petition for Custody can be filed, and ordered. If you truly fear for the safety of your child, you'll do this tomorrow.
