o.k. let's all take a breath and a step back.

Kid, WHY do you want to keep the hubby away from the home and why is his name on the mortgage and not the deed?

I asked this question not for myself but for my coworker. However, even if it weren't for me, the answers with questions attached wasn't what needed to be posted.

But for those who wanted to know; I honestly had lived through the pain of not filing for exclusive rights to the home after my then husband left the house. He robbed me blind daily. My wonderful attorney kept telling me, take pictures, video tape, it will all be worked out. It wasn't. He ended up with thousand and thousands of dollars that needn't be lost on my part.

I did find out here that she must file for divorce first. Until then her husband can do the same as my then husband did. Grocery shop at will, take things at will, and even break in when doing so. Because he is on the mortgage, without filing for exclusive rights he has the right to do so.

And mr. guy with the reverse question. Yes, I could have done the same thing when my then husband took over the residence. I however, was and have always been above those game.

Thank you for all the wonderful responses. It is such a trip asking for help on FA.

Oh and Belize, I never said I was keeping hubby from the home because his name was on the mortgage and not the deed. But it is kind of odd that you ask that question. I so ended up with my name on the mortgage and not the deed to the house I couldn't keep secure. Wonder if I could "grocery shop" now! Just kidding, I am way above those games. I want to keep it legal for myself and my coworker.

You are being rude. So call the damn clerk's office and ask them for the form -- if they don't have one WRITE THE DIVORCE COMPLAINT AND THE MOTION YOURSELF! You have been answered.

Rude?

You were have been rude yourself. You know that I couldn't call the darn clerks office for a form that doesn't exist.

Swearing to make a point will also show ones intelligence.

"A form that doesn't exist" -- exactly. Then why did you ask the forum for one?

Umm, I'd like a time machine. If you don't have one for me, don't respond. :D

Well it happened. The co-owner trashed the house while my co-woker was at work.

He trashed all the snow globes all over the carpet. Broke the entertainment center, tv, dvd player, and turned the couch over on all of it.

She has since filed for divorce and now has exclusive rights so she doesn't ever have to come home to that mess again. Now she has legal rights to change the locks, as well as, press charges if he did this again.
