I was involved in what they are calling a Single Vehicle Accident on March 25, 2006. I had left my house driving on a Farm Market Road and made it a little over 1 mile away. I was driving a 1995 Dodge Ram 2500(3/4 ton), extended cab, long wheel base, Cummins Diesel, Automatic Pickup which weighed approximately 7700lbs. and when coming around a slight curve was thrown from the truck when it rolled. I was air lifted to the hospital with a broken pelvis, collapsed lung, and swelling on my brain. My Pelvis was broke in three places. I spent a week in the hospital and am still in a wheelchair unable to walk or even stand and will be for atleast another two weeks. I do not remember anything about the wreck or the week spent in the hospital which is making this situation even more difficult. I can not imagine this truck rolling! There were no skid marks on the pavement, the road side area where the accident took place had only a slight dip as a ditch, and there was nothing there but grass. I remember leaving the house and I no I was not in a hurry. This truck was as sluggish as they come and I am having trouble believing that I would have been speeding. I have found on the NHTSA website that there have been recalls, investigations and more complaints concerning this type of truck than I would ever thought possible. Almost all of the complaints, and there is 100's of them, concern one of the same things, steering, suspension, brakes, tires, and a serious defect concerning a part in the fuel line which is currently a recall. I found where the part that is a recall has a problem with rubber pieces coming loose and sticking causing immediate, uncontrolled acceleration AND steering and brake loss/failer. The actual recall was suppose to start this month and was to involve all 1994 and 1995 Dodge Ram 2500 Pick-ups. There is also reports concerning brake and steering failure and tire and suspension defects. I tried to find any information or past reports about rollover accidents involving this type of truck but there seem to be none and the NHTSA emailed me stating that they are not required to do crash testing of any kind on vehicles weighing over 8,500lbs and then they added something about 6,000lbs but state that this truck weighed 8,500 and would not be tested under the NCAP program. The truck weight was 7,700lbs. The truck was financed through a bank, I was 2 payments behind, so the bank claimed it was on the repo list and took possession of it from the wrecker service. I phoned them after receiving two different letters within three days from them. One stating that in 60 days my truck was going to be public auctioned and the next one stating that they would auction my truck any day after the date on the letter which was the day it was received. I told them I wanted to be certain the truck would still be available in 3 weeks for pictures and inspection. I told them about the information I have found concerning this truck. They told me they were waiting for their insurance adjuster to look at it and immediately following they would send it to auction where it would be sold for salvage. They said no one, including myself was allowed access to this truck without a subpoena. The only insurance on the truck was what the bank had on it that I paid in addition to my monthly payment. I want to know what went on that day. All I do know is that the truck did not look like anyone would have lived through the wreck. I keep finding where Chrysler/Dodge has covered up, lied, and even blocked internet sites concerning problems with vehicles. I need help!

I feel the bank has no right to deny me access to my truck. It may already be to late! The truck may have been auctioned as salvage and smashed by now. I am still unable to walk and I want to have the opportunity to see, take pictures, and if I feel it neccessary, have someone inspect the truck! I want answers/closure concerning this accident! I should not have to find an attorney just to be allowed access to this truck! What can I do to make the bank allow me this access?
Also, does anyone have information or knowledge concerning the 1995 Dodge Ram 3/4 ton trucks as far as defects and rollover accidents AND/OR the negative situations surrounding the Chrysler/Dodge Companies failure to address problems with this truck and failure to inform the public of such problems?

No but an attorney would have known the word "spoliation" and written a letter to bank and the insurance company requesting that the truck be held for a later inspection. Call an attorney tomorrow morning.

Thank you so much for your assistance! I am having trouble believing that there was no government requirement for crash testing on this truck! I KNOW I came across a site that stated in the crash test result section for this vehicle "RECORDS LOST"! And I am almost certain another site showed "UNAVAILABLE" in the crash test section. This was found the first day I began searching for information and unfortunately I did not have a printer hooked up and am now unable to find this information again! I did come across numerous sites which include the crash test information for all 3/4 ton Dodge trucks year models 2000-2006!! It makes no sense to me that they were not required to perform crash test in 1995 as they claim, but now they are. Something is not right. I can honestly say I do not believe I was somehow the cause of this Rollover Accident! I have done everything I can to find even one record of a Rollover Accident involving this truck! There was one, and if you knew when the truck ran off the road, nose straight down, just how far the drop was, and how large the numerous rocks in the path where you would see immediately why it rolled! It was without a doubt a "tripped" rollover. I see nothing where my wreck occured that points to a tripped rollover.
I forgot to mention that I received a ticket in the mail after my return from the hospital for "Speeding". I have not contacted the police Department yet but plan to in the morning. I know the officer has to do something and I can see how even after doing research he would come to the conclusion that I was speeding. I know I have more than enough information to show that considering what is known that if I was speeding it was due to a known and even recalled defect!
I was wondering if the Police Department has the right to demand that I am allowed inspection of the truck before the bank can do anything with it? You would think they not only have the right to do so, but that they have a responsibility to the public to document and record any information concerning the safety of a vehicle. I would like to know what you think before I talk with them tomorrow.

The bank or the insurance company (depending on the arrangement) is the rightful owner of the truck so it (the rightful owner) gets to decide. I mentioned spoilation because in some states there is duty to preserve evidence if the party in possession is notified by a potential litigant that evidence should be preserved for later inspection. As I said before take this to an attorney tomorrow. It won't cost you anything.
