The end of June I have gave 2 weeks notice and resigned from a Fortune 10 company. My compensation was salary plus monthly commissions. I received a final paycheck and over the course of 2 months received commission checks. The beginning of November I received a letter from my previous employer indicating I was overpaid during the period of January - June. The letter requested a check in the amount of the overpayment. Three weeks later I received a second letter requesting payment or it would be turned over to a collection agency. What legal recourse do I have?

You can request proof of the overpayment. But if they can show that the overpayment is legitimate, your recourse is to repay them.

Oh, I've been around - - here, there and everywhere. I'm down one partner, and so I've been relegated to pick up the slack during the day. I'm in the midst of grooming one of my associates to "partner up". Perhaps, someday soon, I'll be back here full time. But, grooming a new partner is a slow, time consuming and tedious task. I don't want to change the letterhead for just anybody!

Overpayment

I am from VA and i was working in NC. I ended working there at the end of May and they continued to pay me. I didn't realize i was being payed until october and by then had spent the money on school and didn't know what to do. The company has contacted me and asked to repay them. I have a few questions. Am I liable for their mistake? They are asking for the money pre-tax and i was payed post-tax via direct deposit, so they are asking for more than i have recieved. What are the tax implications of all of this? How much time can i request to repay? Another other useful info. would be appreciated. Thanks in advance for your time and help

Daalstar, it is considered bad forum etiquette to "hijack" another person's thread, even if the subject matter is the same.

If this were an old thread that we were pretty sure was finished, I'd go ahead and answer it anyway on a one-time basis. But since this thread was only opened last night and we don't know if the original poster is going to come back to it with more questions or information, it would be better and less confusing if you would open your own thread, okay? When you do that, we'll answer your question.
