I received a letter of mortgage satisfaction from the court house. Records show there is no lien. I called the mortgage company and they said my loan was paid off. I did not pay this off. They refunded me my escrow and fha refunded me my money. Months later, after not making a payment, they said that i owe the money now and they issued me a new loan number. So i started making payments again. Now that i'm refiancing, the title co says there's no lien showing and that i will receive the total refi amount and it's up to me to choose to pay the old lender back or not. Can i get in trouble if i choose not to??

DON'T take legal advice from your new lender!

If the mortgage was released in error then reintstated, you still owe the money. Documents recorded in the register of deeds office sometimes take WEEKS before they show up in a search of the records. It is very possible that the document simply isn't yet showing as posted to the property, so did not appear on the title search that was done BECAUSE the "effective date" on the title commitment preceeds the document posting date at the courthouse.

Do verify all the payments and payment amortization now that the loan mistake was discovred, because you wnat to make certain the amortization schedule is as it should be.

Yes, but all this happened over a year ago. I would think they would a submitted a lien by now

I asked the bank repeatedly to provide proof that the account has not been paid and they have not. Whose to say i don't have a secret admirer that paid it off. All i am asking is proof, since they have not provided it, how do i know i owe it legally?? So basically it's a non secured loan??

**A: yes, and I bet the mortgage company has your signed mortgage note to prove that you owe, you owe, off to work you go.........

If the bank can't show me that the loan is not paid off, and if they can, i refied the home with another bank, the bank could put a judgement against me right without taking the home since the title co. said it's clear and now the new bank is the lien holder???
