school principle got involved

OK I think I got it straight now, just got off the phone with my lawyer. There was a conference between my lawyer, the law guardian and the judge. The school principle sent kids records to all 3 parties. He spoke to my lawyer last week and the law guardian returned his call yesterday. There was a conference with the judge today. There is a conference scheduled with my kids in judges chambers this Thursday morning at 9:00 am.

So dad and HIS attorney were not present at this conference? Your attorney likes to play face and loose with ethics as does the judge apparently. May dad request that the judge recuse himself and then report the judge to the ethics committee of the New York State bar. Then your attorney and the law guardian also have issues.

She called again and dad's attorney WAS there and he agreed 100% with everything?

OG -- could it have been an ex parte motion? That would have allowed just the listed people to be present, right? The emergency would have been dad's alleged plans to take the kids????

I am really a bit confused by the responses here.

Its apparent that dad has made some poor choices in the past, since he has been barred in the past from taking the children to his home.

Its also not at all rational that dad went into the school and told them that custody had changed and that the children would be leaving the school, based solely on dad's petition to change custody. That of course would have raised a big red flag with the school...and again, wasn't rational at all.

We also don't know the details of what the child discussed with the school psychiatrist...but we do know that CPS is involved.

I do not see how we can say that the scenario could not have played out as OP described it...particularly on an emergency basis.

Except for the fact that the principal violated quite a bit as did the psychiatrist, mom's lawyer, the GAL and the judge. You don't see the ethical issues? Oh never mind. Forgot who was posting this.

The school LEGALLY has NO RIGHT to prevent a parent from removing a child UNLESS there is a restraining order. And we do not know that CPS is involved. WE know third or fourth hand hearsay that says they MIGHT have been called and yet CPS hasn't talked to the children. CPS has seen no issues. And, if CPS, is involved and they open a case, that case takes PRECEDENCE over a DR custody matter. And, judges realize this. So a judge is NOT going to make any decision IF CPS is involved until CPS closes their investigation or files a court complaint.

So if you know anything about the COURTS and the LAW, it is easy to see why it would NOT have played out like this person is stating. NOt to mention the school principal SENT the records to at least three different individuals -- including the judge -- and the judge read the ex parte communication and called a conference?

NOPE. NOt happening unless everyone in this is crooked.
 
Spent the whole day yesterday at court. Judge did meet with kids in chambers for which seemed like an eternity. End result is dad can take kids to his parents house as always, his sisters house in Jersey, he can take them anywhere without a lady friend in tow, except his place of residence in Maryland (or into the state of Maryland at all) until trial set in March.
