What is the name of your state? Colorado
I was injured on the job and dislocated my shoulder about six months ago and my case was closed. A few weeks later my shoulder popped out again. I called my boss and told her what was happening. She told me to write an incident report whenever it happened. It happened about 6-8 more times until the end of May and I reported it everytime. I got offered a second job Late in May and took it, working one job on the weekends and the other one on the weekdays. My shoulder continued to pop out until and finally I was sent to have it looked at again by Occupational Health. The did an MRI and said that I would probably need surgery but I had to go to an orthopedic doctor to see what he would do. Now I need surgery. Unfornuately because second job is on the weekdays, I have had to miss work from that job., and will miss a lot more after surgery. Does Workman's Comp pay for lost wages from a second job, or am I just screwed?

No and yes.
In fact, your workmens comp may not pay at all if your recurring injury isn't work related.

Second Job Wages

From California
In the state of CA., if you have 2 jobs and get injured at either, then you are entitled to receive Temporary disability benefits for the 2 jobs. In this case you will undergo surgery, then you'll spend about 2 weeks to a month before you start going to physical therapy, which means you'll be off from BOTH jobs for about 3 to 4 months. You can always contact the W.C. Information and Assistance Officer, they are usually located in the same building where the WCAB is, check the phone book.

Colorado w/c + second job

Many states do have a provision for lost wages from a second job but I can't find anything in the Colorado w/c Act that addresses this. Try calling Colorado workers' compensation and they should be able to answer this question. (Your adjuster should be able to answer this, also). The number to Colorado w/c is 888-390-7936.

Do you really not realize that Colorado is NOT in California (at least not yet)???
And that what applies in California has NO relevance to Colorado.
Your post would have been just as useless if you had let us know what happens in Vietnam, Canada, Pakistan or even on Mars.

Then why the hell did you post. And the reason you can't find anything is because it simply isn't there (as alluded in my earlier post). Other than providing 4-1-1 services by providing a phone number, your post is about as useless as the idiot from California....
Why do people feel compelled to post to this forum when they offer absolutely NO legal or accurate advice or value???

Lawyer

Thank you guys for your posts. I have been at a dead end lately. I did go see a lawyer for a free consultation and she said that in Colorado, for my injury, I would be able to recieve Workmans Comp for the second job. Supposedly I just have to fill out some form, but I haven't found out how to get one without a lawyer. I am still trying to decide what to do.
