My boyfriend and I lived in an apartment for sometime, we decided to split, and both move out of the apartment. I put in a 30 day notice with the ll, and also asked if there was a one bedroom on the property that I and my 2 small children might be able to move into. He said there was and that I could move into the apartment on the 1st once the current tenant had vacated the apartment. He gave my boyfriend until midnight on the 4th to vacate the apartment (which was the end of our 30 days).
On the 1st, I began to move some of my things into the new apartment and noticed that there was a bad roach problem in the unit. At that time, I notified the ll and asked if he could possibly bomb the unit. He did and said I could continue moving in the next day (the 2nd). On the 2nd when I went in to the apartment, I saw at least a dozen roaches, live and dead, all throughout the unit. When I entered the apartment on the 3rd, there were still roaches running around and I notified the ll again that the problem didn't seem to be getting any better. He said I could stay in the old apartment, where I now had most of my things due to the roaches, until he bombed again and gave the unit a few hours to air out. When the morning of the 5th came, my boyfriend had not vacated the old apartment. The ll got upset with him not leaving and told me that if he wasn't gone by days end, I would also lose my new apartment, legal action would be taken against my boyfriend, etc etc. I having no control over what my ex does or doesn't do, relayed the message word for word. He was gone by the end of the day. When I came into the apartment on the 5th and still saw live roaches, I decided I didn't want to "wait for the roaches to die" and subject myself and my children to living with roaches. I informed the ll that I'd decided not to move in the new apartment and would have my things out by days end, but that I would be willing to pay him the pro-rated amount for occupying the new place since some of my things were in there until the 5th, and that I would clean as best I could in the old apartment. He said okay.
On the morning of the 6th, I returned to the now empty old apartment specifically to clean. I vacuumed and cleaned a little before I had to leave. I then called the ll and left a message that my vacuum broke while cleaning the unit, but if he had one I could use, I'd be more than happy to clean the place better when I got his call. He never called. Keep in mind, by cleaning, I meant wiping off counters, mopping, sweeping...nothing heavy as that's all that needed to be done. We only occupied the apartment for 4 months. I never received a callback.
I did a walk through when I moved in the apartment at the ll's request/advisement and filled out a form, but never did a move out walk through. Didn't even think of or think there was such a thing, and was not advised of this by the ll, but I read this on the Dept of Consumer Affairs w.s.
"The landlord must give the tenant written notice of the tenant's right to request an initial inspection of the rental and to be present during the inspection. The landlord must give this notice to the tenant a "reasonable time" after either the landlord or the tenant has given the other written notice of intent to terminate (end) the tenancy (see Moving Out). If the tenant has a lease, the landlord must give the tenant this notice a "reasonable time" before the lease ends. If the tenant does not request an initial inspection, the landlord does not have any other duties with respect to the initial inspection.168"
From my deposit of $750.00, today I received $70.00. Itemization is as follows:
$90.00 for removing excessive nails, screws, fasteners from wall, sanding nail holes, and painting over nail holes (valid)
$225.00 to clean the apartment (excessive in my opinion)
$115.00 to steam clean carpets (isn’t that normal wear and tear?)
old apt pro rate $162.50 (5 days @ 32.50)
new apt pro rate $86.67 (4 days @ 21.66)
He told me I could stay in the old apartment until the conditions on my new one were better (i.e. no roaches), so why would I be charged for both? I now don’t believe I should even have to pay for the new one as it was uninhabitable those days it was infested. Also, are the cleaning charges valid if I was never advised of the possibility of an initial walk through (move out) and offered to clean myself?
Any advice would be appreciated!!!
