seized transfer case

i had my car serviced at a auto center. i had a full service oil change and state inspection. six days later my rear wheels locked up while driving. the transfer case was empty. the garage where it got fixed found no leaks. the place where i had the oil change admitted that they did not check and fill the transfer case. their ads say they check and fill all fluids. they have been unwilling to pay the cost to fix ($1012.00) they said just because they were the last ones to service the car they should not be held responsible. i think they should because their service states they will check and fill all fluids and one component which should have been checked and filled was not and then seized up. do i have a case? new hampshire

Based purely on your post, it certainly sounds like you might have a case of negligence and/or deceptive trade.

I would suggest that you get all your facts together and start documenting the case in anticipation of taking action. Send the auto center a letter detailing your case (certified RRR) and give them a reasonable (5 business days?) chance to respond (check with your local requirements to see if there is a statutory period). If they don't respond or fail to resolve the issues, you should consider taking them to Small Claims court.
