What is the name of your state?nj
I will be closing on a house the 10th of this month. I people who own the house now don't have anywhere to go until the 28th. This is after I have served them a time of the essence letter. So my lawyer ask me if it was okay if the rent the house from me until the end of this month. But there is a little dispute here. They only want to pay my mortgage on a per diem. The question I really want answered is if they are renting my home don't I have the right to charge them what I want per day until they get out instead of only charging the 75.00 per day per the law as my lawyer is telling me because it's the law???

**A: your lawyer is an idiot. First of all, never rent back. If the Seller needs a place to stay after closing, recommend a 5 star hotel or Motel 6, 7 or 8.
Next, as L, if you were to rent the property, you could charge $1000/day if you wanted to.

You can charge any amount of rent you want...but like he said it is not a good idea..but sometimes you have to give a little..but draw a contract describing the condition of house. etc.... :)
