She left the kids with you over a year ago and you don't think she wants you to have custody? I would think after she's been gone this length of time, she wouldn't have a choice.

And yes, if you are given legal custody, she will have to pay child support. In fact, you should be getting temporary child support now. It's really a shame that our legal system is driven by dollars!

She`s pretty much threatened me that if i ever try to file for custody, she will try to take the kids away from me. Can she do that after she left me? She also has in her head that she wants joint custody, and I`m the one that supposrts them. They stay at her house a couple nights a week.Do I need her to agree to give custody to me?

No, you need the JUDGE to agree to give custody to you!!

She can fight your getting legal custody, but having deserted the children and not contributing to their support will certainly count against her. Does she visit them at all? Sadly, custody battles are expensive.

They stary with her a few nights a week. But Im the one that has to handle everything, teachers in school, grades, doing their homework, getting jobs, loan for a car. I don`t get any support or help from her. I have to live my life around her schedule.

I think you need to stop asking her, stop letting her push you around and file for custody and child support.

In your opinion, do you think I would be awarded custody, or would they ask the children which parent they want to live with? One is 17 the other is 12. My wife`s place only has one bedroom, and they girls have been living with me since she left.
