I was served with a judgement from a law firm in the amount of $4500 for a credit card that was charged off, but a CA bought it. I never received any notices from the collection agency to reach a settlement. In the past, I have received settlement offers and I paid them. In addition, I filed an Answer with the courts stating that I did not refuse to pay them and that I did not receive any notices from them. I also stated that I would like to settle the account with the interest being deleted and that I would pay $ 100 a month. I called the law firm asking for them to reduce the amount and they quoted me $3500 but when they sent the papers it was for the entire amount. Is it possible for the total amount to be reduced in court by the judge or does the judge automatically rule in their favor. What should I say in court?

Though it is common (in trying to avoid the cost of litigation), there is NO statutory obligation for the defendant to send you any notices to settle.

First, that is NOT an appropriate answer to the lawsuit. Second, by answering that way (affirming the debt obligation), you have simply given them all that they needed to make their case.... your confession.

You either say that the debt is not valid or not yours AND PRESENT YOUR PROOF... or admit it is and accept the judgment.

One question though.... what is the date of your last payment on the account?

Served with a Judgment or a summons to appear in court for a judge to HEAR a Motion for Judgment? Totally different.

You can be served with a subpoena, or a notice of a lawsuit (summons, complaint, etc.) or warrant for arrest, or a motion on a lawsuit, or other legal PROCESS, but there is NO such thing as getting 'served with a judgment'!!
