I was injured on my job in May and required shoulder surgery August 31st. Three days after the surgery, it was discovered that I had DVT (or a blood clot in one of the deep veins) that was a result of the surgery. Work comp has paid for all medical expenses thus far of the shoulder and blood clot (including required tests to try to determine the cause of the clot).

We are now to the settlement process for the permanant disability. I was informed by the insurance company that they will pay for all medical bills in the future from things that would still be considered a complication or direct result from this injury. Does this include future blood clot issues? (I have had numerous tests run that have determined this was not a pre-existing issue, nor a blood abnormality but rather a direct result from the surgery) I have been told that once you have one clot your chances of another are substantially increased. Would future instances also be covered under the same claim?

Is this something that I need to further investigate with a local attorney that specializes in work comp?

Settlement with complicatons

Yes,ask your attorney about this. Your settlemenet may have to be written up a certain way so that there are no questions in the future concerning the blood clots.Make sure that in the settlement they are taking full responsibility for this issue and any future care that you may need for it.You can also call your labor board and ask them, they have so much information on w/c and your state laws.Good luck
