When facing a lawsuit for outstanding HOA fees, should the Georgia homeowner accept the association lawyer’s first settlement offer? Or, is it best to wait until the lawsuit is filed and hope to get a better settlement through mediation?

It would depend on your argument. If it just that you can't or won't pay, why would you want to force them to file? If you have any assets, they will go through the whole process to get a judgment against you. From what you've written, the only leverage you have is keeping the other side's costs down by not having to file a lawsuit to collect.

**A: the bottomline is do you owe the fees or not. If you do, you take the risk of hoping for a better settlement later.
