A person who has medical insurance they pay for on their own is injured in a store. The medical bills due to the injury are $30,000+ The injured person handles case pro per and without going into details (too complicted) settles the case involuntarily for $1,000. Part of the $1,000 settlement agreement says the person can not take any further actions agains them, their insurers if any can not, etc. Does the injured person need to give the $1,000 to the insurance company? The injured paid co payments, deductables, etc. for everything, but the policy says they should get part of any settlements for injuries caused by someone else.
