I most have the crappiest luck ever....I was involved in another car accident on 11/29/05. My bf and I were on the way to work that morning. As we were going thru the intersection this lady ran the light (blatantly late)and hit the driver's front side. She received a ticket for running the red light. She gave the policeman the wrong insurance company...my insurance company found out her real one thru her VIN. Fast forward to now....she never reported the accident to her insurance company....she won't answer the calls or letters from my insurance company or her own. So now her insurance company won't accept liability b/c they haven't spoken with her. Can they not accept liability since she got the ticket?? Since my insurance company is now picking up the tab...will my rates go up?

I plan to go to court on 12/21/05 to make sure she doesn't dispute the ticket b/c she's been very shady so far.

I swear people in Atlanta can't drive.....you won't believe some of the stuff I see on the road daily!!!!!!

Your insurance rate should probably not go up, as you were not at fault. However, you need to call them to find out for sure. The bummer is you would pay your deductible, and if you had no rental coverage, will have to find other wheels while yours get fixed.

You can try taking this lady to small claims court. Based on the ticket this should be possible. If she does not show up, you win. Getting money from her would be another matter.

Your rates increase wehn you are at fault. However, remember, that insurance rates increase for MANY reasons...including the insurance companies paid out a lot of money in claims and now they are raising the rates in your state for just about everybody. So you may see a rate increase
anyway that probably has NOTHING to do with your accident. Good luck.

Yep. The ticket doesn't PROVE liability.

Only your insurance company can answer that... but if you are NOT liable, likely not.

Oh I had a witness that saw her run the red light btw...she was in the next lane over.

Sorry for this idiot, he should be out of here soon. To answer your question, it's not really a loophole, but rather a "black hole". Insurance that is not interested in paying up would do anything to not pay up. That said, you can take her and insurance to small claims, and win if she does not show up. Witness would help in such case.
