A few weeks ago I was shopping with my daughter in a grocery store and when we came out there was a car illegally parked in a handicapped space that did not have a handicap sticker or license on it. When I came out of the store I had to get something and the cart rolled down a small incline and into the illegally parked car. I gave the owner my name and number but did not get anything from her in return because she was too busy worried about getting her car fixed and to drive out of the parking lot and back into it to park elsewhere to get my car's tag information. A few hours later her husband called to let me know the estimate she got on her car...only 1 and that was where her husband used to work. She did not make an incident report to the police until 3 days after it happened where I went in to talk to them 2 hours later...and during her conversation with the police she drove her mother's car to the station where they would think that she was legally parked on the day of the accident. I know I hit the car with the cart and have not said that I didn't do it....but now I have to go to small claims court because her insurance company I guess will not pay for it. I've told the judge's secretary and my dad talked to the judge and several officers about it and they said not to worry about it. But I am worried about it because I can use the money for something else besides getting her car fixed when she was illegally parked. Any suggestions would be greatly appreciated!!!

Whether the car was parked illegally or not, makes no difference. You didn't have control of the cart and because of that the other car was damaged. You can avoid going to small claims court by paying for the damage.
 
It doesn't matter if the car was illegally parked in the handicap space.....your cart hit her car and she needs to be compensated for the damages.
