I was wrongfully terminated from my job in Austin, Texas
on 9/14 and I'm in real need of obtaining
top legal counsel for a possible lawsuit.

A local district attorney my wife knows, thinks I have
an excellent case that the company will want to
settle as soon as possible because of the evidence
I've been able to obtain. (audio recordings)

There are several things that happened during my 9 or so
months with this company that led to me being fired.

It started several months back when I witness one of the
inside sales guys drinking beer in the warehouse. I informed
him that our boss was just inside & may come out and catch
him drinking on the job.

That's when this individual informed me that our boss buys
beer for the employees to drink, and he doesn't mind if they
drink during business hours. There is an office lady at this
company that would tell the truth if put on the stand, plus
I have audio recordings of our boss making light of this
after OSHA contacted him about it.

I'm the one who called OSHA, who started an investigation
into me being fired because I reported the beer drinking to them.
The company president offered to give me 2 weeks pay, and to
remove all things negitive from my employee file, if I would agree
to have OSHA stop their investigation. I agreed, since OSHA said
they couldn't do much for me anyway. I did not want my job back.

Seems like there could possibly be a suit under the state
whistleblowers act, but I would much rather take this up in
Federal Court, for obvious reasons. (Texas has a limit on how
much you can sue for)

After this incident, and my reporting to OSHA, I went from
being well liked by my co-workers to public enemy #1.

I decided to buy a compact pocket recorder from Radio Shack
to start recording the offensive, hostile, and eventually violent
treatment I started encountering from my co-workers as a result
of me objecting to drinking beer & reporting it to OSHA because
of safety concerns.

I have also caught one of the employees I was having problems with try to follow me home. I called the Austin Police Department and made a complaint for harassment. When he was following me, I went to a friend’s house instead of my own. After staying inside for at least 15 to 20 minutes, I walked outside with these two friends (because they had to leave) and this co-worker that was following me drove by, so I have two witnesses that saw his car. (after I told them exactly what it looks like, including color, and that it was a 4-door sedan)

I believe the inside sales guy had this other employee try to find
out where I live so he would have the option of committing
criminal acts against myself, my wife, or our property. This inside
sales guy told me, quote "you have pissed off the wrong mother f **ker". On one other occasion, he asked me quote "do you want some of me, mother f **ker? Come get some of what I got for you"

I honestly believe this man, and others employees, would like to see something really bad happen to me or my property because of the way he has talked to me & treated me. I have to live with the fact that this man may be so ticked off at me, that he may continue to try and find out where I live & do something criminal.
(At my house, my firearms are loaded & ready to shoot!)

I can prove that this company did not follow their own written
company policy in this matter, and are responsible for allowing
this situation to fester to the point I could be in danger. This
situation has made me very concerned for my safety.

I have on tape numerous times where I had meetings with the
General Manager, and reported these things to him, and he did
nothing to try to stop it. I also informed him of racial slurs being
made by warehouse personnel about several races. He said they
were just playing, while company written policy prohibits this,
and any employee creating a hostile, offensive work environment.

I also have the General Manager telling me he did want me to
tell him what these guys are doing anymore on tape, as well
as admitting that he had no idea what the company handbook
had to say about harassing behavior in the workplace. Therefore, I can prove the General Manager (and the Human Resources
Administrator) were negligent in their duties to adhere to the
company's written policy concerning employee behavior on the
job.

I have many questions about this case, and I have never had to do anything like this before, so I guess I’m going to be needing all
the help I can get.

Look, another lawyer has told you there is a case. I don't know what anyone else can add.

As for the threats, you could likely get a protective order, but who knows if this is going to help much if someone is really out to get you. You may be in over your head....

But this paticular lawyer isn't in a position to be able to take my case. I've found one guy who said he would like to meet with me about this for $50 an hour. He said if he was able to take the case, it would be an hourly deal and I can't afford to pay out a bunch of money for nothing. I really need to find a lawyer that would take this case on a percentage basis, so he'll have reason to work hard to win. (no settlement, no pay)

Is this a reasonable request? I don't want a lazy lawyer looking to milk me out of my savings & care less about winning the case. See where I'm going with this?

I no longer work there, so hopefully the immediate threat isn't as great as it once was. But if it is, I'm carrying fire power & I have no problem blowing holes in these guys if they threaten me. There has already been a police report filed for harrassment against the guys that tried to follow me home, and I told the cops why I filed the complaint (so they would know why I had reason to believe I was in danger if I had to shoot one of these guys)

I hope they don't give me any more trouble, but if they do -it'll be them that are in way over their heads . . . I have the right to protect myself when terroristic threats are made against me. I will not live in fear. I will eliminate the fear if it comes at me again.

Oh come on man what are you some wimp?

you in the south boy, the REDNECK south where alcoholics can still get a full time job, and where drug testing is never done.

You really are not a bright guy.....beer drugs are part of the PAY PACKAGE why give these guys the cash, they would spend it on beer anyway, this way its a tax deuction for the company. And the company doesnt have to pay the SS taxes, and other taxes associated with paying them more money.

If drinking on the job offends you get the hell out of the south.....go to a Northern city where they take this stuff seriously

What law states that you can't drink on the job? Companies may have policies against it, but I didn't know there was an actual written law.
