I was a resident doctor in OB/GYN a few years ago. There was a senior and an attending above me. A baby died. I've heard word now that the woman is suing. Depositions are to be in the spring. Reviewing the chart now a few years later, I think I'm the one who made a mistake. My senior and attending aren't saying it's their fault. Should I just say it's my fault in the deposition and let the chips fall where they may? Or is it professional suicide to do so?

Didn't you post this a few months ago, asking if you HAD to attend the deposition, and if you should hire your own attorney or let the hospital defend you???

I don't see that one, Maybe OP deleted it. Regardless they NEED to seek counsel.

Should you just say it's your fault? kind of like making a deal with the DA where confession yields a less distasteful sentence? The only "person" who can give you the correct answer is legal counsel for the physician licensing board in your state. The "person" to ask this question of the physician licensing board is your liability insurance carrier's legal counsel who is representing you at all stages of this investigation. Without legal counsel, you should maintain absolute silence.

I believe your reviewing the records and determining that you most likely made a mistake is a significant indicator that you have matured as a person and as a physician.

Well if you finally found what happen it must had been an oversight. However, if you and your other doctors all know about this and you are going to admiit it in court then you shouldnt take all the blame if the other doctors know of it too.
