Hi, I'm from Missouri and I need to know if I can do anything about my Mother. She hates my bf and so does my son. My son has bipolar and some other problems. He accused my bf of assault, which he didn't do. They brought criminal charges against him, which I finally got dropped. My mother now says I am abandoning my kids, which I'm not. I take care of my kids but I decided to go out the other night and left my kids with their dad's and my son got into a fight with another kid so ended up calling my mother and feeding her a line about my bf, which she bought into totally. She came and got him and says that as long as my bf is around that I can't have my son. She has called my bf a child molester, which he is not, and everything else and now I can't even be with him and have my kids too. Is there anything I can do to stop her? They used to do this to my husband to when I was with him, and she bought into it every time then too, but now that I'm not with him he is just the greatest guy in the world. Could I get her for some kind of slander for what she is doing to me and my bf? Any help would be appreciated.

NO! This sounds just like typical family squabble stuff. Is she just saying this to your family? This happens all the time.

No, she is not just saying it to us, she has filed police reports and she has called the child abuse hotline twice. They come here and talk to us and see that there is nothing to it and she calls and reports us again the next time she gets mad. If it was just her saying stuff I wouldn't care, but we've got dfs involved by her calling those hotlines and we've been to court once already on assault charges (which were dropped) It's just ridiculous and I'm sick of it.

Cease and Desist

Look into getting a Cease and Desist Order against your mother. If you can prove that her charges are false, you can easily obtain an Order keeping her from bothering you again. Then, if she keeps it up, she will be the one in jail.

About slander and libel, there are many attorneys who give free consultations. Find one and ask what you can do about your mother.

And this advice is about as worthless as implants on a boar hog :rolleyes:

This is definitely the wrong forum for this . . . but for what it's worth. You say "She came and got him and says that as long as my bf is around that I can't have my son." (I assume you mean your mother came and got your son?) If you have legal custody of your child, keeping him from you is custodial interference.

Normally, one would swear out a complaint with the police and they would take it from there. However, it sounds like your credibility might be a little shot where law enforcement is concerned. If this is the case, see an attorney who specializes in family law - and prepare for the biggest mess you can possibly imagine and a complete split down the middle of your entire family.

And as "Jerry-Springer-ish" as your situation sounds, if your mother is deliberately filing false official reports that damage your reputation - which would have to be very good to start with - you could conceivable sue her for libel - there's a public paper trail to follow. It would be most helpful, however, if she had assets you could be awarded in the event you win. Expect a counter-suit; a barrage of investigations and another real big mess.

My advice: move
