Smoking in public is not a right. The US government has already asserted that it has the authority to control chemicals via pollution and OSHA standards. OSHA can regulate how and when toxic chemicals can be used, so why can't the government regulate how and when toxic chemicals can be used by individuals? Within the confines of your own home go ahead and light em if you got em. Once you step out into public places then you are subject to the regulations of the government. Even though a business may be privately owned, the definition of a public place has long since included any business opened to the public as part of its normal operating standards. An exclusive club would be excempt as they are not opened to the public.
Compare to carrying a weapon in public. It is perfectly legal to own a gun, but the government (in some places the state,federal, or both) has banned the the carry of it into public places. When you are on private property have fun to waive it around all you want, but when you go out into public places then you are subject to the authoratative control of the government.
