I have two small kids 5 and 6. I have full custody of both kids for almost 2 years now. Both kids have summer birthdays. My ex has visits 31 days in the summer and every other birthday of the child from 6p.m until 8 a.m. According to our vistation schedule she gets the kids 1st and 3rd weekends until 6p.m on Sunday. The birthdays are exactly four weeks apart. Last year the birthdays fell on her weekend a Saturday so she had them all day Sat and Sun.

I have a party planned for my daughter on her birthday and I asked her if she could bring her back early. She said no because she is supposed to have her until the next day at 8. But, I told her that she is supposed to bring her back at 6. Looking at our schedule who is supposed to have my daughter. I thought that it should be me since she had her all day on her last brithday even though it did fall on her weekend.
Plus she is going to have my son on his birthday this year again because it fall on her 31 days in the summer.

i am not sure how it is in your state but here in oklahoma we have a thing in our orders where any special hoilday ie: birthday's prevails over regular visitation and no matter who the child is with if the judge ordered you share birthdays then that prevails over regular visits.

Without the stipulation for special days such as holidays and birthdays specifically stated in the Custody order, then whomever has the children during these times based on the visitation order should have them.

HOWEVER!!! I am also a father of two girls, 6 and 8 who have birthdays 12 days apart in the summer June 17 and June 29. I have had them only once in four years during that time but guess what, it really doesn't matter.

My ex and I worked a long time to have a decent relationship and we came up with a wonderful solution that hurts neither of us and in fact, is very special for the girls,....We have TWO birthday parties.

Your children are special. Treat them so and you will be the richest person in the world.

If this is her year to have them on their birthday from 6-8 then there is nothing you can do about her keeping them until 8 p.m., even if she did have them last year all day on their birthdays. That is the way visitation works. When the judge ordered the visitation he did not check holidays or birthdays to see who's weekend it would fall on. Over the years this will happen now and again. The only option is to speak to your ex and try to work something out.

My step son's birthday is on June 29th and we have him every summer from the time he gets out of school. It is usually the week before his birthday. Mom has his party ahead of time and calls him on his birthday when he is here.

Someone here said it doesn't matter and it doesn't the kids don't care when they get to celebrate as long as it is a happy time! Maybe you all should attempt to get along enough to have one big birthday party and both attend!

Your order states every other year. Does it state what year this was to start?

I agree with hexeliebe if it is not stipulated in your order that Birthdays and Holidays preside over normal visitation, then the children are with her.

That's exactly what we do too kw (with my kids). Their father has a party for them and I have a party for them ! Wow two parties !
What a treat for them. Doesn't really matter if the parties fall on the exact birthday just as long as they are getting special attention to celebrate their birth !

too late. Our little 'family' here just grew by one. Three Thoroughbred horses, two Chow dogs and one Fox Terrrier, 23 cats and A NEW KITTEN about an hour ago.

Oh, I forgot the camel in the back (it's white)....

This year I'm giving the girls a very special birthday party...in Vienna, Austria where they were born. Last year it was DisneyLand and the year before it was Seattle....

and no, I'm not upstaging mommy, she took them to Worlds of Fun in Kansas City one year, on a fishing trip to Nova Scotia the next and this year they are taking a weekend cruise.

and who is going to bushhog the 40 acres, paint the 2.4 miles of fence, paint the three barns, dredge the creek bed, weed the garden, shoe the horses, clean the stalls (9) and exercise the horses, feed the animals daily (including the camel) and cut the 2.5 acre front lawn.

Oh yes, I almost forgot, one pasture is 30 years worth of manure and it's no fun to cut.
