What is the name of your state? Delaware



I have a friend who needs to file for sole custody of her son. Basically there was never a relationship between the mother and father it was just a drunk type situation and unfortunately he took advantage of her and she became pregnant.

The father lives in another state and has never ever made contact with the child whom is 3. My question is how can she file for sole custody.

Even though the father has never been involved in the childs life or for that matter does not even know his name. She is concerned that one day he will eventually pop up. Although he does not have her address nor does she know his.
 


Well, has the paternity been established? If this man hasn't been established legally as the child's father - then your friend doesn't have much to worry about. Until he pops up at some inconvenient time with a court order for a paternity test, custody and visitation... Sticky wicket, that.
