I was in a bad accident tonight. I was in an umfamiliar area, driving along during a rainy night on a highway type area w/ alot of fast food places and strip malls w/ 3 others in the car, and next thing I know I see a red car coming, hear a loud bang, my car spins around, and I'm in an accident. I make sure everyone in my car is ok, then I get out to see what happened. The driver door of the other car is open, and theres a guy screaming at me telling me I ran a red-light. Both cars were undrivable. He really plowed into me good, leaving hefty driver/passenger door damage and his front end was pounded in. The cops showed up, I said I thought I had a green light, b/c u normally stop on red on instinct. The cops later arrested the guy for outstanding warrants. I then asked the one cop if it had anything to do with the accident, he said no b/c he wasn't the driver, but he really was, and they took off so I coudln't argue he was the driver. The car was registered to the girl in the car w/ him and she claimed to be driving. I think they tried to beat a yellow light since there "appeared" to be no one around and that they could make it. I don't really think I ran the red light, but I might be at fault, I really dont know. Do I have any case here making this not my fault just based on the situation, or also with him not being the driver and whatnot. I always thought that when people run red lights, a high percentage of the time they hit someone, like he did, not get hit like I did. I'm just a little anxious over the insurance stuff, thats all. Any advice or comments is appreciated.

He also claimed, their light went from red, to green so they went. There was no way he hit me just accelerating from a stop at the intersection, he was going way to fast. Will the police report determine this, or is it not serious enough. He had to be going at least 30mph.
 
I don't think you want to argue they were trying to beat a yellow light. If they were that would mean you had a red light and should have been declerating or stopped anyway, which could've prevented the accident. Now if you had a green light and they just ran their red light, then of course it would be their fault. But, from the details you've given, it's impossible to determine that. Who did the cops assign blame to?

Cops said is looks life my fautl, c/ as of now, there were no witnesses, and its his "sure" word against my "unsure" word. I just don't want my insurance rates to go through the roof. If it is determiend my fault, can I be cited for running a red light?
