What is the name of your state? north carolina i am getting remarried and want to move out of state with my fiance. i have temporary custody of my 8 yr old son. my ex pays child support but has no visitation rights, as a matter of fact has a restraining order against him for myself and my son. do i need to do anything to prevent him from trying to stop us from moving? he is saying he will try to stop us. please help......

I'm sorry that I can't tell you anything definite.

I know that sometimes that it can be a problem to move a child out of state and sometimes you need to file something with the courts first.

If it were me, I'd call the courthouse and see if someone there knows. If they don't, then I'd call an attorney and ask them or a paralegal.

Likely you should give him 30 days written notice that you intend to move to give him time to contest, but since there's a restraining order, you may wish to contact an attorney about this.

I think that you should contact the courts but i don't think that you have to have his permission because he no vistation and he has a restraing order against him
