She is 14....he is 17. I have not spoke to her family. My understanding is that her mother is "making" her keep the child. Do/es we/ my son have any say. What about child support? My son is still in High School (11 grade) and works on Saturday's at a warehouse ($8.00 hr). Will I be expected to pay? What about his dad, would we both have to pay? How is support determined when children have children?
Since this is very new news I am playing it cool......worried the age of my son might become an issue. I hope that by offering to support her and her families decisions they will not make his age a problem.
Any advise on how to handle this situation would be greatly appreciated.

He can get in trouble if her parents press charges and if they don't the court may. And he probably will be expected to pay child support to support his child.
My only question is why did you let your 17 year old son date a 14 year old? And vice verse, why would her parents allow her to date your 17 year old son.

I believe you and her parents should all sit down and talk about this situation, and options. Whether she is going to keep the child and raise it, or if you want to put it up for adoption.

Your son will be paying child support. Her parents can press charges for statutory rape. You (and actually they) have no say in whether she keeps the baby or not. What on earth were all of you adults doing and thinking?

Your son, who decided to date and rape a 14 year old, will be held liable for child support. In addition, the parents may be able to sue you in civil court (which has a much lower standard of proof) for contributory negligence, and win an award against you... and if you don't have insurance to cover such events, it could mean the loss of your home.

This is a very typical situation that teenage children get themselves (and their unfit parents) into. Kids with little or no guidance, and parents who are, for the most part, unfit to raise a child, are a bad combination.

Texas does NOT have a statutory rape statue. And the sexual assault and indecency statutes require a MINIMUM of three years difference between the actor and the victim, which has never been established here.

Therefore, based on the facts given in the post, the CHILD SUPPORT issue and that of paternity are the ONLY issues which can be answered at this time.

You need to get ready for what may be a VERY interesting time.

First, lets look at the child support obligation:
Yes, your son WILL be liable for child support, etc. until his child is 18 years old or older (depends on the family court ruling, end of education, marriage, etc.). And until he is 18, his parents (YOU!!) can be liable for the payments.

Now, the criminal:
Depending on EXACT birthdays, he is very likely guilty of violating several Texas laws regarding sex with a minor. And yes, at 17, he can be found as an adult.... and be criminally charged as such.
Some of the potential charges per the Texas Penal Code are:
§ 21.11. INDECENCY WITH A CHILD.
§ 22.011. SEXUAL ASSAULT.

I'm not particularly interested in what you have to say, as most of it seems to be the uninformed ramblings of an armchair expert. You seem to be flying off the handle, as evidenced by your opening statement... "Texas does NOT have a statutory rape statue." Yet I never mentioned STATUTORY rape! Pay closer attention next time, instead of referring me to statutes that support your misguided viewpoint.

I suggest that instead of relying on the Internet as your legal research tool, you jump onto Lexis/Nexis and Westlaw and research recent Texas case law. Insofar as the original question that this thread is about, it was accurately answered.

Not by you idiot. Unless you can cite Texas penal law that proves this was rape.

THAT was what I was referring to. Well, that and your stupid little games on this forum. Which, by the way, won't last too much longer.
