Obvious Speed Trap got me this week. Ticket is in SC and is in a small town on rual HWY. I saw a posted sign that stated "speed zone ahead" and it dropped from 55 to 45 mph. THEN the speed dropped to 35 with no warning. I was crusing along below 45 (I know because my wife asked me why I was going so slow). I then heard the siren and pulled over. The cop stated he needed my liscence and insurance because he was going to issue me a citation for speeding 51 in a 35. I asked to see the radar where he had locked me in. He stated that when he was done I would be able to see the radar. After completion he read me my court date and related info. He also stated that he had given me an envelope to mail in the fine in case I didn't want to appear at thier "fine" courthouse. I noticed $150.00 written on the ticket. I then asked to see the radar and he stated as he pointed "there it is on the dash". As I attempted to get out he told me I wasn't going to "see" it because he wasn't required to "lock-in" my speed. I then asked to see the last date of calibration (because in GA the tickets have a place for date of calibration) and he then turned to walk away. I asked to see his supervisor and he gave me a number which I could NOT get to work. As I was on the pay phone trying to reach his superior we noticed his friends that he was talking to at the local wing shack looking and smirking our way. I feel I was targeted because I was 5 hours from home (GA plates in SC). I know for a fact I was NOT speeding (and I have had a few in long time past). I also know taht this town is a trap because of the same police car with the same uniformed dummy cop sitting in the same place it was a week earlier as I passed through. Also, if it makes a difference or not the car was unmarked. He stated that he had to spped through "several lights" to catch me when there were only two that I went through.
My question is...
1. Can I fight a speeding ticket in a very small town and win?
2. If I lose will there be any points transfered to my record in my state?
It seems that the fines are $50 for every 5 mph over since 51 in 35 is $150.00. Also my court date is on the 26th of this month and the ticket was issued on the 5th. Isn't this mighty fast for that type of fine? HELP!
