speeding in a construction zone?workers present?

i was leaving work as i have done for over three years at the same location. the speed has been 60mph the whole time. this day, i traveled over 2 and a half miles when i came upon a sign, "road work ahead" i slowed down and stopped in line with the trafic waiting for the "one lane ahead". that is when i was pulled over(in line) for speedin in a const. zone with workers present. after the officer let me go , i drove back to my place of employment to see where i went wrong, or where i should have known that there was construction. there was nothing. not one pylon(cone), not one barracade, not one vehicle or piece of const. equip. of any kind, and not one person in sight or any kind of sign, contruction or speed limit. the officer claimed i was going 70 in a 55mph const. zone. in addition to this nt being a const. zone or workers present. he also rounded up to 70 from the 68 i had my cruise control set at. i believe i was going 68 in a 60.i plan on fighting the double fine. what advice can you give me?this was in florida.

Try going back to the construction zone and speaking with the foreman. He/she should have a copy of the workers schedules. If nobody was working during the timeframe in which you received the ticket? Then………well…nobody should have been there? How can the police support a case for “workers being present” when nobody was scheduled to work? Just a thought………………..

I’ve never herd of on officer “rounding up” the ticket. Did he get you with radar? Or by pacing? If radar, ask to see the calibration records (you have a right to do so)You’re your lucky, he didn’t have it calibrated and cant be used in court. It’s a long shot but worth checking out.

Now that I think about it…how could he “pace you” if you were sitting still when he pulled you over? Hmmm………must have been radar then?

I am a state traffic engineer with DOT . A 55 MPH speed limit sign should be posted - a law has been passed for 55 MPH in all construction zones. If workers are present, the fines can be doubled, and an orange sign will be displayed indicating that workers are present. If no workers are present, the "Workers Present" sign should be covered, however, the workers do not have to be present to be fined; the sign that said "Road Work Ahead" indicates that you are approaching a construction zone and you should not be exceeding the 55 MPH.

This may seem unreasonable to those of you driving through the construction zone, but spend an hour out in the roadway working with cars and trucks speeding by you at 68 MPH (and greater) and you might have a better understanding of the need for the lower speed limits in a construction zone (they need to be lower than 55 MPH). The number of deaths (workers in the construction zone) is continuing to increase; lowering the speed limit is one of the first steps taken to try to prevent these deaths.
