No, they don't. They can't squeeze blood out of a turnip, and they for damn sure can't continually stack on more and more fees. If he fails to appear, they can FTA him and charge the extra there, but the offense carries only one penalty. They can't continue to create more and more crap for a minor traffic offense. Not a good option for someone that can't pay the initial fine to go the FTA route.
Not they don't ALWAYS have that option. Your location shows you're in California... And if you knew ANYTHING about Traffic Citations in California, you'd know that "sitting it out" is NOT an option. Florida might be the same.
Sure, they can offer him community service, and he still has the option to tell them to go get bent. He DOES NOT HAVE TO ACCEPT WHAT THEY OFFER. This seems rather difficult for you to understand. While some people seem to always bow down and smooch butt when it comes to Court, I do not.
He has the right to refuse anything that he deems unfit for him and his present position. Sure the Judge can say, "I am ordering that you pay this within 6 months." And he has every right to tell the Judge, "No your Honor, I'm not paying it today, in 6 months, or 6 years. I do not have the resources to pay this. What I do have is all of the time in the world right now to go sit in your jail while this is being taken care of with the time that I have."
And sure the Judge can tell him that he will not accept that, and that he is giving the defendant 1 year to pay the fine. And the defendant has the absolute right to tell the Judge, "No your Honor, you seem to have a hearing problem. I believe I just said I was not paying this now or ever." That will usually piss off the Judge to agree that maybe time in jail would be better.
Problem solved. The Court didn't get his money, and he gets to sit it out. The Court doesn't always get what they want. I have personally seen this done. That's where I get the scenario from in the first place.
