undefinedWhat is the name of your state? Virginia, City Caroline. Was going at 95 in a 65 interstate road. was issued a Virginia uniform summons, a court citation. Can anyone please tell me what can possibly be the consecuences for this ticket. I've had my licence for a year and a half and have all my points.

You are going to have about six less points and a lot less cash. Virginia automatically charges you with reckless driving if you are going over 80. At 95 you will not be offered a reduction without an attorney and maybe not even then. Did I mention those wonderful insurance surcharges that you will be enjoying for the next three years? Happy speeding.

DO NOT WAIT....HIRE A LAWYER!!!!!!!! I was going 81/55 and was basically told by the judge, prosecutor, lawyer, etc that if i were going 83 or above that i was basically looking at automatic jailtime. Virginia doesnt screw around with speeding....they are VERY VERY strict. You should contact a lawyer in the county you received your ticket in. They give free consultations. I was very fortunate to recieve a huge fine instead of jail and license suspension. I have several other friends who have been caught speeding and werent so lucky....they had to do jailtime for excessive speeding. The courts also arent lenient if you've only had your license for a year and a half. If anything they are more strict on younger drivers! I've had my license for 11 years and had one prior ticket...so i was actually postive 4 points. The most you can have is a positive 5 and thats perfect. Had i not had the positive points I also dont think I would have been so lucky.

Thank You For Your Advice But Damn They're Strict! Do You Know If The Same Law Would Apply For An Interstate Road?

95/65 - you are lucky they didn't arrest you on the spot. Reckless Driving is a CLASS 1 MISDEMEANOR offense in Virginia (same category as DUI/DWI/drunk driving).

Get a lawyer. Unless you already HAVE a CRIMINAL RECORD, you'd probably want to have this taken care of, since a CONVICTION will give you that. And it won't go away either (like a speeding ticket).

Could be jail, fine, suspension - who knows? One thing is for certain, you do NOT want a conviction on this charge if possible.

wow i cant believe that that constitutes reckless driving, Ive goten a 120/55 here in ny and just got a ticket and drove away no reckless even, ill have to remember that when driving thru virginia...

reckless => CRIMINAL RECORD in Virginia

Yeah, 120/55 will get you jail time for certain. Better read up before you even think about rolling thru these here parts.

thank you for your advice but isnt it a little exagerated i mean its my first ticket ever. I called them and they told me they wont give me jail time but the fine might be high like a thousand dollars. Anyways if i were to get a lawyer i would have to pay twice as much and still a fine for speeding.-

Do U Know Akon's Song?

My consequences of my reckless/speeding conviction was that I GOT LOCKED UP, a hefty fine, and a 6 month suspension. All this WITH a lawyer which the judge told me I needed to come back with after my first court appearance without one. This was in Fairfax County where they don't play, but I'm not sure how they do in Caroline. All I can say is expect the worse and hope for the best! Vaya con Dios!

Conclusion Of Case

Well here's the update i went to court it was scary cause they do lock ppl up but i just got a fine because the judge denied my petition for driving school. the fine was $350.00 because i had a clean record if not it would have been $500.00. Since my stae is Maryland not Virginia i do not get any points and thats the end of the story.
My advice to you all DO NOT SPEED IN VIRGINIA! they are very tough, take it easy while in this state they dont play and got no problem in locking you up.

Reckless Driving

Your comments are very helpful.

Can any one tell me what is the likely State penatly I will receive from the General Disctrict Court in Fairfax County, Virginia for driving 76 on a 65 mph interstate road (on a rainy day)? I received a Virginia Uniform Summons to appear at the end of the month. I am 40 years old and have a clean driving record.

Personally, I would say just do not visit the communist republic of Virginia if at all possible! The overbearing and unrealistic enforcement only makes it MORE dangerous....

Federal Highway Administration.Effects of Raising and Lowering Speed Limits. Report No. FHwA/RD-92/084. McLean, VA. June 1996.

A general boycott of the State would help! I know I am not going to Virginia Beach for vacation anymore....

Cepe's advice is not "Follow the law" it's "Don't visit places you might get caught" Interesting...
