Speeding Ticket

Hi. This is the closest subject I saw about speeding tickets. I got a ticket at 2:30am yesterday by a cop that was hiding at the side of the highway. The officer had no lights...whatsoever....on...isnt that illegal?

I thought theyre there to make highways a safer place but yet they parked on the side of the highway with no lights on...and making the highway more dangerous?

In most States that is called entrapment. Do you have any witnesses? Otherwise, as usual it will be your word against his. If he wasn't hiding behind anything then he was not really doing anything illegal just being sneaky.

no i didnt have any witnesses :( and i don't have a good driving record either. what would you suggest i do?

i've seen him hiding there before, do you think it'll be any benefit if i record it next time i spot him at the same spot with his lights off?

I suggest you slow down a little,especially if you know that,that is a usual hiding spot for him. I wouldn't advise recording unless you have another person in the vehichle with you to do the recording. Take it slow, there's nothing in the world worth getting hurt or maybe even killed over.

Thanks very much. I usually dont drive fast, it was just 3am on a monday night so i set cruise at 82....

so its not illegal for him to be on the side of the highway with no lights on?

No, it's not. And, there is a Traffic Law/ Moving Violations forum where this would have been more suited to be posted.

Actually, in every state, that's called "perfectly legal" and also "a really bad defense". I suggest you re-read the definition of "entrapment".

That's perfectly legal in CA.

And it's only unsafe if the person driving on the highway has a tendency to (illegally) drive on the shoulder and not in his or her lane.

That is NOT entrapment. Please look up the definition.

The police are not required to play fair and provide neon signs saying "Here We Are" when they are enforcing traffic regulations.
