SSN being used by another person

What is the name of your state?What is the name of your state? Arizona
Someone in CA is using my Social Security Number for medical/dental insurance with my insurance company.
Question: Is my health insurance company negligent for allowing someone in another state to receive medical insurance under my social security number?

They will not tell me the status of the account or release any information to me. I have a fraud alert on my credit reports and filed a report with the Federal Trade Commission for the use of my SSN by another person.
What can I do next?

Your carrier is prohibited under federal law from disclosing any information to you about claims made by another individual.

Put your complaint in writing to your carrier along with supporting documentation of the identity theft. If this is an employer sponsored plan, copy HR

No, the company is not negligent. If this person provided your number and said it was his, they have no reason to disbelieve him, no way of knowing that he is lying, and no legal obligation to verify each and every SSN that is provided to them.

If this is an employer sponsored plan DEFINITELY notify HR or whomever is responsible for your company benefit plans.

Thanks both for your answers.
I can't begin to explain how frustrating this is and the lack of knowledge on the part of law enforcement as to what to do and who to go to.
I'll write the insurance company as you suggested.

One other thought . . .

It is unusual for identity theft to be used in such a way . . . to steal "benefits" under a medical plan. It may be the fraud goes deeper by filing false claims in an attempt to steal from the carrier. There may be others involved here, such as medical practitioners.

Might be a good idea to report this to the DOI in AZ and CA. There have been insurance fraud criminal "rings" in CA that have been discovered and prosecuted.

Thanks somarco, I'll do that.
One note of interest; I may have caught this early enough that it has not effected me much personally. Nothing strange or out of place appeared on my credit reports. Also, my health insurance company is telling me that the account in CA no longer exists and was cancelled by the HR manager of this other company. This all came about when my insurance company asked that HR department to verify the SSN.
Interesting to say the least.
