Hubbys daughter will be 23 in March and will be graduating in May 2008. He pays child support and not in arrears.
According to divorce papers.....Termination of the support..The husband's obligation to make payments for the support and maintenance of the child in accordance with ..and so on.. shall terminate when the child is emancipated which shall be defined as the first occuring of any one of the following six events.
1) reaching the age of 18 years or completion of high school or 4 years of academic college education or attainment of post graduate degree, whichever last occurs except that the husband shall have no obligation to pay child support or contribute to the auto insurance premium for the child after the child graduates from college:
2)marriage of child ......and so on, which the others don't really apply now.
My question is, when should he start paperwork to have her emancipated? Wait until college is over, get something from the school showing she will be graduating in May and do it at first of year so that once graduation gets here he is done.
And does he need a lawyer for this? He is not really anticipating any problems with ex because daughter will be graduating and it is doubtful that daughter will continue on with a higher degree. It has already taken 5 years for a 4 year degree as daughter really hates school.
