What is the name of your state? What is the name of your state? Florida

I have a friend who is 19 and naiive. He met a girl who told him her age was 17. He stupidly believed her. After talking, he gave her the address of his home and a few days later she showed up unannounced. Long story short, they had "consensual" sex that night. He drove her home the next morning and was disgusted and surprised to find out that she was only 12 years old. She then lied to her guardians by telling them that she had been kidnapped and raped by two men. After his arrest, she recanted and admitted to falsely portraying her age and initiating the sex act.

Currently he is awaiting bail and facing second degree felony charges. He has been told that he will probably receive 12-15 years. He has no prior arrests. What are his best chances in avoiding incarceration? I understand from some of the statutes that he is guilty regardless of her consent due to her age.

His family is in no financial position to hire a lawyer. Any advice on what to expect? What to ask or do now?

TIA

SEX WITH CHILDREN STANDARD ANSWER

“If you have to ask whether it's legal or not, then regardless of whether the answer is yes or no, it's a very, very bad idea.” --cbg

Moms Arrested For Allegedly Condoning Sex Offender Relationship
WVIT-TV

LITCHFIELDConn. - Two women have been arrested for allegedly allowing a sexual relationship between their children.

State police arrested the two mothers Tuesday, accusing them of condoning a relationship between a 14-year-old girl and a 24-year-old man.

State police arrested Lorraine Pereira, 42, in Torrington, Conn., the mother of a 24-year-old convicted sex offender. She was charged with risk of injury to a minor and is now out on a $5,000 bond.

Pereira is the mother of Nathaniel Pereira, a twice-convicted sex offender ordered on two prior occasions by a judge to stay away from underage girls. Pereira was taken into state custody last month.

Police have charged a 32-year-old Goshen woman, the mother of the 14-year-old girl, with risk of injury to a minor.

According to the arrest warrant, Nathaniel Pereira spent several nights with the young girl in a motel room in Goshen, Conn., and his home in Torrington, where he lived with his mother.

"This is a sensitive investigation. It involves a young female and therefore we're doing everything we can to protect that female's identity," said State Police Sgt. Paul Vance.

Standard answer

Here are some hints on appearing in court:

Dress professionally in clean clothes.

Do not wear message shirts.

Don't chew gum, smoke, or eat.

Bathe and wash your hair.

Go to court beforehand some day before you actually have to go to watch how things go.

Speak politely and deferentially. If you argue or dispute something, do it professionally and without emotion.

Ask the court clerk who you talk to about a diversion (meaning you want to plead to a different, lesser charge), if applicable in your situation.

Here are five stories that criminal court judges hear the most (and I suggest you do not use them or variations of them):

1. I’ve been saved! (This is not religion specific; folks from all kinds of religious backgrounds use this one.)

2. My girlfriend/mother/sister/daughter is pregnant/sick/dying/dead/crippled and needs my help.

3. I’ve got a job in [name a state five hundred miles away].

4. This is the first time I ever did this.

5. You’ve got the wrong guy. (A variation of this one is the phantom defendant story: “It wasn’t me driving, it was a hitchhiker I picked up. He wrecked the car, drug me behind the wheel then took off.”)

Your friend will soon be getting more sex than he knows what to do with... from black men, white supremists and mexican-americans. I suggest that he go to a doctor and ask for a set of anal dilators, then start using them. By using progressivly larger dilators over a period of time, his anal sphincter will stretch without hurting or tearing... thus allowing him to accomodate the multiple penetrations he'll soon be receiving more easily (and with much less pain).

The alternative is for your friend to go to prison unprepared, be violently raped, and end up with anal tears and a perforated rectum. Since he's only 19 years old, he will no doubt end up being the submissive in a jail-house sexual relationship. While it is true that he'll have a 65% chance of catching HIV while in prison, he can at least take steps to mitigate the agonizing pain that anal rape can cause.

That was hilarious.
