I had left my ex-husband (he was in the Army) and returned to Michigan (our original homestate) when our son was a year and a half old. We were later divorced and my ex did not come to see my son until he was three. Since then he has missed numerous visitations. He has child support taken directly from his paycheck, so he does not miss payments. He gave me permission in 1998 to move our son from the state of Michigan to live with my current husband (who is in the Air Force and has been like a father to my son since he was just under two). Since that has happened, my ex never calls (he never did in Michigan either), never writes or sends presents (even for his birthday) and sees our son only twice a year--Christmas and summer break--when the order allows for much more time. We know that in Michigan when a child is 12 they are no longer obligated to visit with their non-custodial parent. Our son is 7 1/2 now. When he turns 12 how likely is it that a step-parent adoption can take place if that's what our son wants?

You may want to check your state laws, but adoption should be able to take place at anytime, just as long as your ex agrees to relinquish his parental rights.
