By the way, if namecalling is all the intelligence you have, go discuss this issue with your local District attorney or yourself for that matter. Because I don't get into intellectual discussions with unarmed idiots.

It just so happens that his opinion was that he wouldn't touch a case with thos circumstances with a ten foot pole and that the only way he would pursue criminal charges against a step-mother in that situation for kidnapping was if dad was demanding the child back and the step-mother refused.

Hi, thank you all so much for defending me, esp. bloomer. Plaff you do not know what goes on in my house to know if I am lying or not. Which by the way I DO HAVE PROOF. I have plane tickets (3) when he came to visit at halloween, thanksgiving, and christmas. My mother in law has been over countless times, we are good friends, and she knows the situation. Sister in law also knows the situation, not to mention countless friends in our neighbborhood that know the situation, that know and are friends with my husband also. When I moved, I moved to OUR house in Texas. If I was kidnapping dude, it wouldn't be to our own home, where we lived for 10 years before going to colorado to work. smarty pants.
Is that enough proof for you to shut up, I legally have her now. And yes I know he can come to my doorstep and take her if and when he wants, and there is nothing I can do about it. That is the reason of my questioning...HELLO..

As for your PROOF, it's nothing. All you have are tickets. they don't even prove that he was on the plane.
And you STILL don't get it. You have NOTHING legally. You have possession. And that is nothing in the eyes of the law.
As for Bloomer, whoever this idiot is, they forgot to tell you that regardless of what a district attorney told them in the 'neighboring county' where they live, it has absolutely no bearing on your situation. All that matters is how the prosecuting attorney IN YOUR jurisdiction feels about the case, how Dad decides to proceed and the specific circumstances of your case.
But then, you came here looking for the answer that would agree with you as evidenced by your replies, NOT what the law states.
So, you'll get what you want. Or better still, what you deserve.
