What is the name of your state?
Hi I recently took a supervisor position but now i want to go back to my previous position within the same company and department. Upon request they told me that they will check if they can accommodate the same position. It seems that they want me to take a position lower than my previous position with lower pay..is this legal ?

If your old position is no longer available, your employer does not have to create a new position for you. So, yes. Based strictly on what you have disclosed here, it's legal.

Yes. The employer does not have to put you back into that old position unless you have a contract with the employer (and a contract requires more than just an assurance from the employer) or you are a member of a union with a collective bargaining agreement (CBA) that guarantees you that option. If the employer doesn't have any openings available at your old position it is unrealistic to expect the company to create an opening it does not need just to put you there. It may have to fill you into some other position instead, and that may be lower than what you had before. All of that is legal.
