What is the name of your state? NY
My husband has a son from previous relationship, recently the mom took my husband back to court for an upward mod. We went to court in October for our initial appearance. Our lawyer indicated the child is working full time and is no longer in school, etc. etc. We do know you have to pay support til he is 21 but here are our questions.
The mom has withdrawn her petition for following through with the modification if we withdraw ours for going through with emancipation.
Our lawyer advised us to draft something up to put a medical cap of medical reimbursements and they would not agree to that. The real issue is the son does not have health insurance. The mother cannot cover him anymore, and neither can we because he is 20 years old and not attending any school any longer.
Are we supposed to pay the price because he does not want to get his own insurance? I know you can get low cost health insurance these days. And for all we know his employer offers it but he just doesn't want to take it out. This doesn't seem fair, and I think for this reason there is really something wrong with NY state law.
Our support obligation will stop permanently in 6 months from now.
We heard back from her lawyer that she wants everything to stay as it was, but the way his support order reads currently is the mother is to provide health insurance and my husband is to pay 50% of all uninsured medical bills. Well if you want to get technical she is not abiding my the current support order.
Our fear is that what happens if he gets into a car accident or needs surgery, god forbid. Those bills could be astronomical. We are only trying to protect ourselves.
