What is the name of your state? PA I contacted a Fencing company last week and they sent someone to do a free estimate on Saturday. The following Tuesday I received a phone call but did not reach the phone in time. I called back the company and immediately applogized for the delay, explaining that I was in a wheel chair. Later in the conversation, I asked a question similar to, " if I called later today and asked you to build me a fence, when do you think you could begin?" and the man replied "What are you a retard too?" I was shocked and asked why he was being rude to me, pointing out several times and things he had said, even once appologizing to me for his behavior. He said he could give a **** me and my fence and did not want my business if I was already questioning things he said. Just before hanging up he said not to call him again, he was the owner and they would have nothing to do with me. I did call back and asked for the name of the Insurance company, information generally posted in a conspicuous place when he said he was calling his lawyer. I asked for the Lawyers name and offered to make the call myself when he said if I called again he would call the police and press charges against me.
I was just so hurt by his remark, as I have only been disabled for a short time and I know it's no excuse for me to call him back like I did. Reguardless can he get away with behaving like that, calling me names ect?

If you are going to make fun of your own disability, then it will be very hard to prove anything he said offended you. Offending you is not a cause for legal action. You yourself said sticks and stones!You can call anyone a name you want. If we could sue for people calling each other names. The courthouse would have to be open 24/7. I would say shame on him for bad business. I would say shame on you for calling him back. If he told you not to call him back, and you did, you could be in more trouble than him.

I was not making fun of my own disability, I was making light of it. I believe there is a difference. And yes I did name the title Sticks and stones as in will break my bones, but words can not hurt me. Its an old saying, perhaps as old as Shakespere for all I know. But my point was trying to ask, am I overreacting here? Yes I was and am very hurt by not only what was said, but how it was said, and I did make it short, to the point, rather than dragging out every little thing that he said to me.
Isn't there a difference between calling names as you put it and what happened here? Belittling someones disability and refusing them business perhaps on that basis? I do know. I did not say I wanted to sue him, but I did not make clear what I wanted. I am not vendictive. I am surprised thought that you could read a paragraph and be prepared to throw so much shame around, shame is not something I would wish on anyone.

If words can never hurt you, then why are you whining about them.Yes, you are overreacting. He can deny service to anyone. It's his right. Have you ever went into any business and read the sign on the wall, "We reserve the right to refuse service to anyone?" You say that you didnt give us all the information, well noone can help you without ALL the information. The law is not based on just the information you WANT us to know. You have no case. Sorry that you had to experience such an idiot. The world is full of them, we have all been accused of being one from time to time. :)
 
Fence

You have no cause of action. You chose to speak to him after he belittled you. You could have hung up after the first remark. You chose to continue the conversation. Unfortunately, one can say whatever they choose providing they are not advocating sedition, treason, slander, libel, etc. Don't call again.
