stopping child support

What is the name of your state? Montana

My husband has an 8yr old daughter from a one nighter. We have always paid child support on time, we send packages etc. But we get NO replys-no school pictures nada! 5yrs ago the mother and child moved out of state, and we have not seen or heard from the child in over 5 years untill recently the mother called to tell us that they would be moving to Europe (she married a military man) we know we will never see her- My husband would like to give all rights and quit paying child support for a child that we have no relationship with, the mother told us that her husband who has been with the child since she was atleast 3 would be adopting her-ridding us of any further payments but she has not and now in one week will be going off to Europe, HOw can my husband give up his rights and stop Paying child support???????

File a motion with the court for custody of the child.

When the mother gets the supoena she will most likely contact you with the paperwork for the adoption.

Well, it also requires the husband to be willing to adopt and actually go through with it.

I'm sorry if this reply makes me seem like a witch, but your husband accepted that he did make this child with this woman. It is his responsibility to help take care of his daughter. My DH has kids from 2 previous marriages (one of which we have primary physical custody) and the other that we never hear a darn thing from except when his mother wants more money. To me, this whole situation seems to be about money, not the welfare of a child. This is just my opinion, but I think that child would be better off being adopted by her mother's new husband. At least he wants to be part of her life, not just pay the bills.

I'm sure youre not a witch and it is just your opinion, may I add that my husband was 16 and the woman was 22, not that this changes the fact that the child is his- I agree fully that the new husband should adopt, and wish he would. But check your atleast section, we have tried SEVERAL times to be part of the childs life, and we pay the bills!!!!!!!!!!!!
