I'm not at all certain that they can legally fire you for getting a restraining order. Seems to me that this would be a wrongful termination of the public policy variety.

It's up to you how you want to handle it, but if I were you I'd be calling (first) the DOL to investigate that possibility and (second) the EEOC to file a sexual harassment complaint.

I don't exactly have experience with this kind of employment situation but from the little bit I know, any reputable club has a "hands off" policy (excepting such, er, "services" as lap dances" and even then there are limits as to what a patron can do.) Just because she's a cocktail waitress in a strip club does not entitle a customer to manhandle her, stalk her, or harass her and management is obligated to deal with it if they're aware it's happening.

I also agree that if she's fired for getting a restraining order against this creep, she may have one heck of a lawsuit for a public policy violation.

I know I am not the original poster but thanks CBG and Beth for your answers...I was thinking along those lines as well and asked about the EEOC.

It is good to know that you all thought it was wrong as well.

Liverman is my last name - I was teased mercilessly as a kid.

I didn't quit last night, and I obtained a lawyer this morning. I am filing for a restraining order and then we'll see what happens. My lawyer said pretty much what you 2 did, they can't fire me for that, and it'll be a hell of a lawsuit. There is a hands-off policy, but it is not very well enforced.

Thank you for the replies, I have done as much as possible to this point (including checking the want ads!), and now that I have an attorney I feel very secure.

I worked in a club, too. I'm very familiar with the environment. If it were me, I'd go ahead and file the R/O - your safety comes first. Then I wouldn't tell them. Let the guy come in the club and say nothing. You're in a "somewhat" public place and he probably won't harm you there. Go ahead and have him picked up the next time he follows you home, though. See what happens from there.

As for using the club as a reference for getting another job after you've done this - and even if you haven't - you're kidding right? It ain't on MY resume! It's also not likely that you'll be able to work at another club in the area. They're thick as thieves in that business. Gee, I wonder if we worked for the same guy - the one who owns clubs all over the country? Initials S.C.? :(
