stuck with house??

I was divorced in 2002 and the house we lived in ( a mobile home ) was awarded to me. The house note is still in his name but the papers state that I am to assume payments on this note. He is not paying me child support anymore because he was fired from his job. I cannot make the house payment anymore because he's not paying me the money, I no longer live in this house I am actually trying to sell it. I cannot possibly afford to make the payments and I honestly don't care what happens to the house at this point. I just want it gone but if he's not paying me I can't pay them so if the house gets taken what can he do? It will affect him not me as far as credit but what kind of trouble can I get into and can I force him to take the house back? :confused: :(

Have you talk to the bank that holds the loan on the mobile home? If not, you need to do so. Different companies deal with these matters in different ways. Some don't care what a divorce decree states, all they want is their money and they will go after the person whose name is on the note. Some do care what the decree states and will come after both parties.

If your name is not on the note you wouldn't be able to sell it either. Was there no stipulation in the decree about refinancing the loan into your name?

The temporary orders stated that I was to get the house in my name however I was never able to do this because of the shape of my credit which he left me in so he agreed that as long as I made the payments he wasn't going to make me do it. He has agreed to let me sell the house because he didn't want to take it back either.

No I haven't talked to the bank yet. (it was faster getting a reply from here than from them, it took me 2 years just to get them to send the bills to a different address!) The only thing they have is a copy of the decree that states it was awarded to me. But the bill is still coming in his name just my address.

Someone asked me about an assumption deed if I had one, what is this? If I don't know if I have one then I guess I don't, does this make a difference?
